Applicability and Scope
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply to all business relationships between Harcane Industries SA (hereinafter referred to as “Harcane”) and the customer (hereinafter referred to as “the customer”, “the buyer”, or “you”) concerning products (hereinafter referred to as “products” or “goods”) purchased online via our website rahven.store (hereinafter referred to as “online store” or “website”).

Individual agreements concluded with the customer shall prevail over these GTC. Any differing or conflicting terms from the customer shall not be recognized under any circumstances.
Harcane Industries SA reserves the right to amend these GTC at any time. All amendments take effect upon their publication on the website. The decisive moment for the applicability of the new GTC is the delivery date of a confirmed order when purchasing one of our products.
Please read our GTC carefully before placing a confirmed order. By placing a confirmed order for one or more of our products, you declare that you approve these general terms and conditions and the associated privacy policy. You also declare that you are entitled to enter into legally binding contracts and are at least 18 years old.
Formation of a Sales Contract
The illustration of products in the online store does not constitute a legally binding offer on the part of the seller, but merely a non-binding online catalog or an invitation for customers to place an order for one of our products online. Harcane expressly reserves the right to change the products displayed online, as well as associated content such as illustrations, product range, prices, and descriptions thereof, at any time and without prior notice. Images, representations, brochures, advertising, and any other information related to our products are for informational purposes only and are not binding on Harcane.
The customer may place a confirmed order for the products they have chosen via our online store. The customer may also add the selected products to the “cart/shopping basket” without this being considered a confirmed order.
A confirmed order is considered any validly finalized order, the final step being to click the “Buy Now” button at the end of the ordering process. Before the final submission of an order, the customer may at any time change the data they entered, identify any errors, and correct them if necessary.
An order confirmation will be sent immediately and automatically by email to the customer. This confirmation email contains your order details and the GTC you accepted during the ordering process. The confirmation email is for informational purposes only, indicating that we have successfully received your order. This automatic order confirmation does not yet constitute a sales contract. By placing an order, you confirm that you have read our GTC and approve them without reservation. We recommend that you save these GTC on your computer.
After you have placed a confirmed order, Harcane is free to accept or refuse it at its sole discretion by informing you via email and disclaiming any liability towards you or third parties. In the event of any payment already made, it will be refunded to you upon cancellation of the order.
Reasons for refusing an order may include a product no longer being available, our not having received any proof of payment from the customer, or when there is reason to believe that the customer is acting fraudulently or in a criminally reprehensible manner with regard to the GTC or individual agreements, or for any other serious reason.
After your order is accepted, the sales contract becomes legally binding. The acceptance of the order is confirmed by the shipment of the ordered products.
Any commercial distribution or resale of our products is strictly prohibited.
Availability and Provision for Undeliverable Products
All information regarding the availability, dispatch, and delivery of a product is general information and indicative values. They do not constitute legally binding or guaranteed shipping or delivery times. Harcane expressly disclaims all liability for out-of-stock products, shipping delays, or delivery delays.
Our products are available subject to availability. If Harcane finds, during the processing of your order, that the ordered products are no longer available, you will be informed without delay. In this case, no sales contract can be concluded for products that cannot be delivered.
Furthermore, we reserve the right to limit the number of items that can be purchased by a customer. In such a case, the customer will be informed by email.
Prices and Shipping Costs
Our products and prices correspond to those displayed on the website. All prices are indicated in CHF (Swiss Francs), € (Euro), or US$ (US Dollars) excluding the statutory value-added tax (VAT) of 7.7%. The total price of your order, including all ancillary and shipping costs, is shown at the end of the ordering process. In case of parcel shipments to countries other than Switzerland, additional customs duties may be levied. These are not included in the price and must be paid by the customer.
By placing a confirmed order, you declare that you approve the total price of the ordered products. After a confirmed order has been placed, the price can no longer be changed.
Harcane reserves the right to change prices at any time. Products will be invoiced at the price indicated at the time of the confirmed order.
Payment Conditions/Creditworthiness Check
Orders are payable immediately.
The customer has the option to use the payment methods indicated on the website or during the ordering process. These may vary from time to time and by country. Furthermore, we reserve the right not to offer certain payment methods on a case-by-case basis and we reserve the right to offer others (depending on the respective creditworthiness of customers, in order to cover our credit risk).
By choosing their payment method, the customer authorizes payment either by providing their credit card details or by communicating access data to a payment service provider. The customer authorizes Harcane to approve or receive payment according to the chosen method. In case of debit cancellations (chargeback), Harcane is entitled to reimbursement of the associated costs and bank fees. Furthermore, Harcane does not assume responsibility for any fees or other amounts that your credit card issuer or bank may charge you following the processing of your order payment.
If you pay using a credit card or by choosing an alternative payment method, we reserve the right to check the validity of your card, its limit, and the address data on it, and to ask the card issuer or payment service provider if they have given their authorization. Furthermore, you confirm that the credit card is valid and that the related data is accurate. In case of payment refusal, Harcane reserves the right to cancel the order and suspend the shipment of goods. In this case, we will contact you immediately.
Delivery Conditions
Delivery within Switzerland is generally carried out by Swiss Post Ltd. For worldwide deliveries, the following shipping services may be used: DHL, TNT, UPS. The resulting costs must be paid in advance by the customer.
The risks associated with the shipment of goods are transferred to the customer as soon as they are handed over by Harcane to the carrier of its choice.
Products you order that we have in stock will be delivered to you within 3-15 business days after receipt of full payment. You can use [the tracking number] to track your order in real-time.
When products are listed as out of stock at the time of order, Harcane will endeavor to deliver them as quickly as possible after restocking. Harcane will make every effort to meet the indicated delivery times. However, Harcane is not responsible for delivery delays, regardless of their cause. Should the delivery of your goods be delayed, we will inform you as soon as possible.
If delivery is still not made 3 weeks after the initially agreed deadline, the customer is entitled to cancel their order. Any other claims are excluded, particularly regarding damages.
If the shipment of the product fails due to the customer’s fault despite three delivery attempts, Harcane may withdraw from the contract. In such a case, any payments already made will be refunded immediately.
Retention of Title
Harcane retains ownership of the delivered goods until full payment, and the transfer of risks occurs at the same time.
Right of Withdrawal and Right of Return
Conditions
For any purchase of our products via our online store (with the exception of certain products; see Restrictions on Withdrawal below), you, as a consumer, have a 14-day right of withdrawal after receipt of the products without needing to state reasons. Within 14 days following receipt of the goods, you or a third party other than the carrier you designated, may withdraw from the contract by returning the goods to us or by informing us of the formal withdrawal from the contract in writing (e.g., postal mail or email). The 14-day return period begins the day after receipt of the goods and is valid provided that the goods or the withdrawal notice are sent to the post office or another transport company no later than the last day of the period.
The condition for exercising the right of withdrawal is that the goods have not been used, are returned to us in their original, undamaged condition, and, if possible, in their original packaging. The goods, in addition to the duly completed acknowledgment of receipt, must be returned to the following address:

Consequences
If you withdraw from the contract and the return of the goods is duly completed, we will refund you the total price thereof, excluding delivery costs, within 14 days at the latest from the day we acknowledge receipt of the contract withdrawal or the returned goods. The refund will be made using the payment method initially used and will always be credited to the account used for payment unless expressly agreed otherwise.
Please ensure that you have access to the indicated bank account, as Harcane assumes no responsibility in this regard.
We may withhold the refund until we have received or recovered the goods, or until you have provided proof of shipment of the goods, the date taken being the earlier of these events.
Restrictions on the Right of Withdrawal
The right of withdrawal does not apply to contracts for products that have been packaged according to your own specifications or for those that have clearly been adapted to your needs (customized products, individualized products), or when the delivery concerns products that have been opened after delivery and are no longer suitable for return for health or hygiene reasons.
Notification of Defects/Warranty
Harcane guarantees that the goods correspond to the described quality criteria and have no defects affecting their value or their suitability for the intended use.
After receipt of the goods, the customer must immediately check that the delivered product is correct, complete, and free of damage. Defects or damages must be reported to Harcane within 14 business days. Defects that could not be detected during a proper inspection and were only discovered later must be reported in writing immediately after their discovery. If you have not checked the goods for defects or if you do not report them immediately, the goods are considered accepted, and you no longer have the right to make any claims against us.
The legal provisions regarding warranty for manufacturing, material, or production defects apply. The warranty period is two years from the receipt of the product. Products that have been damaged due to the buyer’s fault are excluded from the warranty.
The customer’s warranty rights are limited to [replacement delivery or correction of defects/repair, to the exclusion of any other claims]. Harcane decides at its sole discretion whether to provide a replacement delivery or to repair the product.

The defective product must be returned to us at the above address with a copy of the invoice and a detailed description of the defect found. The return of a product is at the customer’s expense and risk. Please keep the documents proving the return of your goods, as without them, we would not be able to process your claim in case of parcel loss.
Create an Account
After creating a customer account and registering, you can check the status of past, current, or recently ordered products, view your address data, manage, and save any payment data. With your data thus saved, you are no longer required to re-enter it for a new purchase.
When you create such an account, you undertake that your personal data is complete and truthful. You are obliged to treat access data confidentially and not to make it accessible to unauthorized third parties. Harcane guarantees to treat your data confidentially and not to communicate it to unauthorized third parties.
Registration is free. Each customer is only entitled to one account. We reserve the right to delete certain applications, as well as to warn, close, delete, or modify the content of customer accounts that violate our GTC or individual agreements.
Harcane is not obliged to register a customer’s account or to accept an order from a registered customer.
Complaints and Claims
We attach great importance to satisfying our customers. You can reach us at any time using the contact information mentioned above. We will endeavor to answer your questions and examine your complaints as quickly as possible. We will contact you after receiving the documents, entries, or complaints you have sent us.
If you have any complaints or claims to make, please help us identify the exact problem, if applicable by attaching a copy of your order or at least your order number and customer number, etc. We will make sure to respond to you within 10 business days.
Liability
Liability arises from the legal provisions in this regard.
However, whether based on a contract, following an infringement, or for any other reason, all liability is expressly excluded in cases of minor or moderate negligence, or in the event of consequential damages. Consequential damages are understood to include, for example, loss of profit, material damage, reputational harm, and data loss due to a temporary deficiency or interruption of Harcane’s services. Furthermore, Harcane assumes no contractual or extra-contractual liability for damages caused by auxiliaries responsible for providing the service.
Subject to the foregoing, Harcane’s liability, according to these General Terms and Conditions, is limited to the price of the goods the customer ordered from us – irrespective of the merits and to the extent legally permissible.
Events Beyond Our Control
Should an event occur outside our sphere of influence and control (force majeure), we assume no liability for non-performance or delayed performance of our obligations under these General Terms and Conditions and the resulting contractual relationships. Events considered to be beyond our sphere of influence include, for example:
Strikes, lockouts, or other industrial actions caused by third parties, invasions, terrorist attacks, wars, fires, explosions, storms, floods, earthquakes, landslides, epidemics, pandemics, other natural disasters, failure of public or private communication networks, inability to use railway, river, or air routes, to drive a vehicle, or any other means of private or public transport.
Should any of these events occur and affect the fulfillment of our contractual obligations, we will inform you as soon as possible.

Severability Clause
Should any provision of these General Terms and Conditions prove, for any reason, to be contrary to law, null, and void, the validity of the others shall nevertheless remain intact. Unless otherwise agreed, the void provision shall be replaced by an effective provision of the same meaning and purpose, aiming for an economic objective consistent with the parties’ intent at the time of contract conclusion. The same applies in the event of a legal loophole in these General Terms and Conditions.
Applicable Law
Substantive Swiss law applies to these General Terms and Conditions, to the contractual relationships arising therefrom, and in the event of a dispute, excluding conflicts of law and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for natural persons is Harcane’s registered office or the customer’s domicile. For legal entities, the exclusive place of jurisdiction is Harcane’s registered office.
These provisions are valid only insofar as there are no binding provisions stemming from the law of the state in which the consumer has their habitual residence. If such provisions exist, they shall prevail over these General Terms and Conditions.
